Terms of Service

Welcome to PushPlay (pushplay.dev). These Terms of Service ("Terms") govern your access to and use of the PushPlay platform, website, and services (collectively, the "Service"). By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

PushPlay is operated by Matt Mazzega, an independent developer based in France ("we", "us", or "our").

1. Overview

PushPlay is an AI-powered platform that generates changelog videos from your GitHub pull requests. The Service analyses your code changes, generates a narrated video summary, and delivers it for you to share with your team, stakeholders, or community.

2. Account Terms

  • You must be at least 16 years old to use the Service.
  • You must provide accurate and complete information when creating an account. You authenticate through GitHub OAuth.
  • You are responsible for maintaining the security of your account and any activity that occurs under it.
  • One person or legal entity may maintain no more than one free account.
  • You must notify us immediately of any unauthorized use of your account.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • Attempt to gain unauthorized access to any part of the Service, other users' accounts, or any systems or networks connected to the Service.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Use the Service to generate content that is defamatory, obscene, harassing, or otherwise objectionable.
  • Resell, sublicense, or redistribute the Service without our prior written consent.
  • Reverse engineer, decompile, or otherwise attempt to extract the source code of the Service.
  • Use automated means (bots, scrapers) to access the Service in a manner that exceeds reasonable use.

4. Payment Terms

PushPlay offers the following plans:

  • Free — Limited video generation at no cost.
  • Starter — Paid monthly subscription with increased limits.
  • Pro — Paid monthly subscription with the highest limits and additional features.

Payments are processed securely through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis until you cancel.

  • All fees are stated in USD and are exclusive of applicable taxes.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • We do not offer refunds for partial billing periods, except where required by law.
  • We reserve the right to change pricing with 30 days' notice. Continued use after the effective date constitutes acceptance of the new pricing.

5. Intellectual Property

Your Content

You retain all ownership rights to your code, repository data, and the videos generated by the Service ("Your Content"). By using the Service, you grant us a limited, non-exclusive license to process Your Content solely for the purpose of providing the Service to you.

Our Service

The Service, including its design, features, code, and documentation, is owned by us and is protected by intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it as described herein.

Feedback

If you provide feedback or suggestions about the Service, we may use them without obligation to you.

6. Data & Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal data. By using the Service, you agree to the collection and use of information in accordance with our Privacy Policy.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure. AI-generated content may contain inaccuracies; you are responsible for reviewing all generated videos before publishing or sharing them.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of (or inability to access or use) the Service.
  • Any conduct or content of any third party on the Service.
  • Unauthorized access, use, or alteration of your content.

Our total aggregate liability for all claims related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or €100, whichever is greater.

9. Termination

You may stop using the Service and delete your account at any time.

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice, effective immediately. Grounds for termination include, but are not limited to, breach of these Terms or conduct that we determine is harmful to other users or the Service.

Upon termination, your right to use the Service ceases immediately. We may delete your data in accordance with our Privacy Policy, unless retention is required by law.

10. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you by email or through the Service.

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of France, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of France. Nothing in these Terms affects your rights as a consumer under applicable mandatory consumer protection laws.
